Can I sue spammers who won’t stop after repetitive times being asked?

Additional Info:

I have a GOOGLE email account, and I have been receiving non-stop spam from a company, who claims to be American/Chinese and they have an office in Delaware. My state has anti spam laws (Idaho). What do you think I should do? Do I have a case, as trivial as it may seem?

Why is the Fourth Circuit Court protects spammers?

Law & Ethics
Ron H asked:

In spite of the conservative government Congress is passing laws that invalidate state laws, why is this? Is Congress becoming the one-stop-shopping place? The CAN-SPAM Act preempts state anti-spam laws. Judge J. Harvie Wilkinson of the Fourth Circuit held that the Oklahoma law prohibiting spam e-mail which “misrepresents any information in identifying the point of origin or the transmission path of the electronic mail message,” or which “contains false, malicious, or misleading information which purposely or negligently injures a person,” to be invalid.

Why are states rights being lost at a fantastic rate with a conservative government? States rights are suppose to be a plank in this party.
