Do I deserve a replacement computer after 4 trips to Best Buy to fix with the extended warranty we purchased?

When we purchased our Sony VAIO desktop computer in November of 2003, we purchased a $200 extended service plan (warranty) for 3 years. Since then the hard drive in the computer has fried twice and the fan and motherboard has had to be replaced. We just got our computer back (after a 3 week delay because they had to ship it out to be fixed) and last night the fan went crazy and was extremely loud, and the computer is erroring like crazy.

This is the 4th time in 3 years that our computer has had nasty problems. I am glad we have had the warranty, but at this point it is just ridiculous! Each time we have to take the computer in it takes 3 weeks or more to get it fixed, we have to start fresh again because the hard drive crashed (we started backing it up after the 2nd crash).

We have full antivirus and anti spam/phishing protection, so it’s not like we’re putting ourselves in this situation over and over.
Our warranty expires in 4 days and I don’t want to get stuck with this problem after the warranty is expired because Best Buy couldn’t get the job done in 3 years time.

I’m so sick of going around in circles. What can we do?
To None: We have a desktop, not a laptop. Would you appreciate Best Buy’s answer being the they will “give you a break” on another model? Great, I have to pay Best Buy for another computer, when the one I have has never worked properly.

    Yes, I would demand a new Computer. And if they do not give you one, RAISE HELL! Talk to the Manager…don’t mess with the cheesy sales and techs, they know nothing.
    Best Buy warranties are a joke.

    If all else fails, threaten a lawsuit and tell them you are calling the Better Business bureau and you will be calling the local Newspaper and letting them know all the troubles you have had with Best Buy and tell them you hope the enjoy the negative publicity you will bring upon them if they do not REPLACE your computer immediately.

    MAN, I wish I could go with you, I’d get you a new computer. Best Buy people don’t fuck with me!

    I do beleive that the lemon law comes into play after the 3rd fix… let them know that you’ve hired an attorney to look at the case… hopefully they won’t call your bluff.. Or you actually can hire an attorney…. most will not ask for money unless you win the suit…. If you sue for other things beside the computer, you will have the money to pay the attorney…

    I would demand a new computer. I have done that before with other electronics and if you get angry enough and very firm, they will probably let you trade in for a new computer. Best Buy is really good about that, as long as they believe you’re serious. I’ve gotten a new iPod after a previous MP3 player broke and the plan was only a “Service” plan, not the “Replacement” plan. I just demanded that I get a trade-in and they did it!

    I would tell them, this is it, this apparently is a lemon, and we want replacement simple as that, and I would have contacted the BBB online, and you can file a report and they get right on these sort of situations.

    you have 4 days left on ur warranty, take it back say you want a new pc or ur cash back if they say no then then they have broken the warranty, term you can have them .BBB. get in befor ur warranty .runs out

    Tell them you want another computer, make sure you talk to somebody high up in the food chain. Your warrenty, will still cover your computer, because your problems started before your warrenty ran out. You have to be very very stern, tell them you will not do business with them anymore, if the problem is not fixed immediately!! I will give you some phone numbers that you can call, if you don’t get any results. You also might want to call sony, and tell them the problems you are having with Best Buy. They hate it, if you call the company that is selling their products, and do not do right with the customer..good luck click here for phone numbers>>

    I would write a very long letter to both Sony and Best Buy detailing your hardships with this purchase and explaining your frustrations. I would make it well thought out and well written being careful to not use profanity or pose any ridiculous threats despite your anger. Simply explain your unfortunate experience and convey how this situation has forced you to reconsider any future purchases with Best Buy or of Sony products. And maybe throw in a comparison to purchases you’ve made with their competitors that have gone smoothly and embelish a little so that it appears like you are going to take your business away from both of them for good, and how you are mentioning this to all of your friends and family. I think that would be your best shot at getting what you want; you could always try going in to Best Buy and asking for a manager to scream at. If you get crazy enough in front of other customers and you make some valid points, you may get lucky that way; but that all depends on the personality of the manager you are confronting. If you choose to take the scream at the manager path, get their name if things don’t work out and include them in the letter.

    The Lemon Law only comes into effect if the SAME problem cannot be fixed three times. In other words, they get three chances to fix an identical problem. Unfortunately, you purchased a lesser version of the warranty they offer, which means they get to send it out and take as long as they need to fix it (as opposed to the in-home version).

    Firstly, count the number of days that you have not had the computer due to warranty issues and call the customer serivce and demand that those days be tacked on to the warranty (after all, those are days lost that you could not take advantage of the warranty). That right there will buy you like 3 months, and they WILL cave over this.

    Secondly, go to the store and ask to speak to the General Manager. Calmly explain the issue. Make them aware that you know the lemon law, as well as their policy (which extends the lemon law to the extent of their warranty), and that you use the computer for work. Because it has taken them so long to fix all of these problems, you are considering getting the BBB involved, and that you have also contacted your attorney to investigate a disruption of business lawsuit. Tell them that you would like to continue to be obviously a good customer, but feel wronged over the whole situation. You are probably not getting a new Sony laptop no matter what, because the problem with laptops is that the margin on the unit is razor thin, so the store may only make $50 on a $2,000 unit. HOWEVER, if you stay cool, they may give a huge break on a model that will be comparable to yours, but much cheaper due to technology.

    If you do feel the need to flip out, do so in a manner that is embarrasing to the manager, and that they feel the need to appease you just to get you out of the store. If you do it in such a manner that makes the manager uncomfortable/scared/angry, they will ask you to leave and you will get nothing.

    Some hard drive problems can be easily fixed yourself by using easily available tools. I found the info at useful. After trying this you can decide your furteher action.
